Welcome to the Sun and Sea Island Rental website, available at www.sunandseaislandrental.com. These Terms of Use govern your access to our website, online reservation services, and vehicle-rental services.

By using this website, making a reservation, or submitting payment, you agree to these Terms of Use.


1. About Us

Sun and Sea Island Rental provides car, golf-cart, and related vehicle-rental services in Grand Turk, Turks and Caicos Islands.

2. Eligibility to Rent

To rent or operate one of our vehicles, the primary driver must:

  1. Be at least 25 years old.
  2. Possess a current, valid, government-issued driver’s licence appropriate for the type of vehicle being rented.
  3. Present the original driver’s licence and any other requested identification before receiving the vehicle.
  4. Be legally permitted to operate the vehicle in the Turks and Caicos Islands.
  5. Meet any additional eligibility or insurance requirements communicated during the reservation or pickup process.

We reserve the right to refuse or cancel a rental if a customer cannot provide the required documents or does not satisfy our rental requirements.

Only drivers approved and listed on the rental agreement may operate the vehicle.


3. Reservations

A reservation is subject to vehicle availability and is not fully guaranteed until it has been confirmed by Sun and Sea Island Rental and any required payment has been successfully processed.

Customers must provide accurate and complete information when making a reservation. We may cancel a reservation if the information supplied is false, incomplete, or cannot be verified.

Vehicle photographs are provided for illustration. A comparable vehicle may be provided if the reserved vehicle becomes unavailable due to circumstances outside our reasonable control.


4. Prices and Payments

All prices displayed during the reservation process are subject to availability, applicable fees, and any additional services selected by the customer.

Online payments are processed through Plug’n Pay and its associated financial-service providers. Sun and Sea Island Rental does not control your bank’s authorization process, exchange rates, foreign-transaction fees, or other charges imposed by your card issuer.

A reservation is not confirmed if payment is declined, reversed, disputed, or otherwise unsuccessful.


5. Cancellations and Refunds

Customers must submit cancellation requests at least 24 hours before the scheduled pickup time.

For an eligible cancellation:

  1. The customer will receive a refund equal to 50% of the booking cost.
  2. A $10 cancellation fee will be deducted from the refundable amount.
  3. Payment-processing charges and other non-refundable fees may also be deducted where applicable.

Cancellations made less than 24 hours before pickup, failure to collect the vehicle, and failure to provide the required identification or driver’s licence may not qualify for a refund.

Approved refunds will be returned to the original payment method. Processing times depend on the payment gateway, bank, and card issuer.


6. Pickup, Return and Late Returns

Customers must collect and return vehicles at the agreed location, date, and time.

Late returns may result in additional hourly or daily rental charges and other reasonable expenses incurred by Sun and Sea Island Rental. Extending a rental requires our prior approval and may require an additional payment.

Failing to return a vehicle at the agreed time without authorization may be reported to the appropriate authorities.


7. Fuel

Unless otherwise agreed in writing, customers must return the vehicle with the same fuel level it had at pickup.

Customers are responsible for:

  1. Fuel used during the rental.
  2. Refuelling charges if the vehicle is returned below the required fuel level.
  3. Damage caused by using the wrong type of fuel.


8. Vehicle Use

Customers must operate the vehicle safely, responsibly, and in accordance with all applicable laws.

Vehicles must not be:

  1. Operated by an unauthorized or unlicensed driver.
  2. Used for unlawful activities.
  3. Driven recklessly, dangerously, or while the driver is impaired by alcohol, drugs, or any substance affecting safe operation.
  4. Used for racing, speed testing, towing, or carrying prohibited items.
  5. Taken outside approved areas or off-road unless we provide written permission.
  6. Overloaded beyond the vehicle’s passenger or weight capacity.
  7. Sublet or transferred to another person.

The customer must secure the vehicle and its keys whenever it is unattended.


9. Damage, Loss and Accidents

Customers are responsible for loss of or damage to the rental vehicle occurring during the rental period, subject to the applicable rental agreement and insurance terms.

This responsibility may include:

  1. Collision or body damage.
  2. Damage to tyres, wheels, glass, mirrors, seats, equipment, or accessories.
  3. Lost or damaged keys.
  4. Theft, vandalism, or misuse.
  5. Towing, recovery, repair, administrative, and loss-of-use expenses.

Any accident, theft, damage, or mechanical problem must be reported to Sun and Sea Island Rental immediately. Customers must cooperate with us, the police, insurers, and other relevant parties during any investigation.

Customers must not admit liability, promise payment, abandon the vehicle, or arrange repairs without our permission, except where emergency action is reasonably necessary to protect people or property.


10. Traffic and Parking Violations

Customers are responsible for all traffic tickets, parking fines, towing expenses, impound charges, penalties, and other violations incurred during the rental period.

We may charge the customer for these amounts and any reasonable administrative expenses associated with identifying the driver or responding to authorities.


11. Rental Agreement

These website Terms of Use do not replace the vehicle-rental agreement signed or accepted by the customer.

The rental agreement may include additional terms relating to insurance, deposits, authorized drivers, prohibited uses, vehicle condition, damages, and other rental requirements. If there is a conflict concerning the use of a vehicle, the specific rental agreement will control to the extent permitted by law.


12. Website Availability and Accuracy

We make reasonable efforts to keep our website accurate and available. However, we do not guarantee that it will always be uninterrupted, error-free, secure, or current.

We may correct pricing, availability, description, or technical errors and may cancel an affected reservation. If we cancel a confirmed reservation because of our error, we will refund the amount paid for that reservation.


13. Intellectual Property

The website’s branding, text, graphics, photographs, design, and other content belong to Sun and Sea Island Rental or their respective owners. They may not be copied, modified, distributed, or commercially used without permission.


14. Limitation of Liability

To the fullest extent permitted by law, Sun and Sea Island Rental will not be responsible for indirect, incidental, or consequential losses resulting from use of the website, a reservation, or circumstances outside our reasonable control.

Nothing in these terms excludes or limits liability where doing so would be prohibited by applicable law.


15. Indemnification

To the extent permitted by law, customers agree to reimburse Sun and Sea Island Rental for losses, damages, claims, fines, and reasonable expenses resulting from:

  1. Their violation of these terms or the rental agreement.
  2. Their unlawful, negligent, or unauthorized use of a vehicle.
  3. The actions of an unauthorized driver whom they allowed to use the vehicle.


16. Governing Law

These terms are governed by the laws of the Turks and Caicos Islands. Any dispute relating to these terms, the website, or a rental will be subject to the jurisdiction of the courts of the Turks and Caicos Islands, unless applicable law requires otherwise.


17. Changes to These Terms

We may update these terms periodically. The revised terms will be posted on this website with a new effective date. Continued use of the website after an update constitutes acceptance of the revised terms.
